Mounds View City Council December 10, 2001 <br />Regular Meeting Page 22 <br /> <br />Acting Chief Brennan indicated that violations on school property are a misdemeanor and the <br />first two offense are handled by the School District and the third offense is handled by the <br />County Attorney. <br /> <br />MOTION/SECOND: Quick/Thomas. To Table this Matter to the Next Council Meeting. <br /> <br />Ayes - 4 Nays – 0 Motion carried. <br /> <br />Council Member Marty asked if the matter could be put on the Consent Agenda. <br /> <br />City Attorney Riggs indicated that the matter required a roll call vote. <br /> <br />Council Member Marty thanked Mr. Lofquist for coming. <br /> <br />C. Introduction and First Reading of Ordinance 691, Amending Chapter 502 <br />(Intoxicating Liquor) and 503 (3.2 Percent Beer) of the Municipal Code <br /> <br />Assistant City Administrator Reed indicated that this was before Council as a result of work <br />session discussion concerning Chapters 502 and 503 as they relate to charitable gambling. She <br />then indicated that Council had requested that language requiring nonprofits to have a registered <br />office in Mounds View before they can conduct charitable gambling was deleted and a 10% fund <br />to be contributed to the City was added. <br /> <br />John Wharton of the Lions Club indicated that he is opposed to the Ordinance change because <br />the Lions always make a point to make sure the money stays local and if the City makes this <br />change it opens up the City to outside gambling operations that would not benefit Mounds View. <br />He then indicated there is a large health care society that is very aggressive and holds 130 <br />licenses in the state of Minnesota. <br /> <br />Council Member Thomas explained that it was not the intent to take out the requirement to be <br />part of the City and said it is the intent to redo the entire Ordinance in January. She then noted <br />that there is a Mounds View group that is not allowed to function in Mounds View and that is <br />why the Ordinance is being changed. <br /> <br />Mr. Wharton asked whether the City was aware that there are specific allowed uses for the funds <br />and that all expenditures need to be reported to the Gambling Control Board. <br /> <br />Council Member Thomas indicated the matter would be up for discussion again in January. <br /> <br />Brian Blaziak of 2361 Laporte Drive indicated that the Lions do use the funds for the community <br />and all charitable gambling benefits this City through fire, police, the food shelf, school projects, <br />and scholarships and if the Ordinance is altered in this way it could stop the ability to give to the <br />Community. <br />
