Mounds View City Council January 28, 2002 <br />Regular Meeting Page 29 <br /> <br />and the Department of Administration as well as checking the statutes and the authority being <br />requested does not exist. <br /> <br />City Administrator Miller indicated that Mr. Coughlin had asked for the same copies Council <br />Member Marty but, when told he would be charged for the information, had decided to make the <br />request to view the information instead. <br /> <br />Mayor Sonterre encouraged Council Member Marty and City Administrator Miller to sit down <br />and discuss the City’s policy for clarification. <br /> <br />Council Member Stigney clarified that any resident could come in and view information that is <br />public data but would be charged for any copies requested. <br /> <br />City Attorney Riggs indicated that under the statute a resident has the ability to review <br />information but, if a request for copies is made and fulfilled, residents will be charged for those <br />costs. <br /> <br />Council Member Marty indicated that when he came in the first time and was told it would cost <br />him $200.00 he said he would just review the information. <br /> <br />City Administrator Miller indicated the policy was changed to deal with the numerous requests <br />and exorbitant amount of staff time being taken up with the requests. She further commented <br />that the City Attorney had advised that the City should start enforcing the data practices law that <br />states that the City can recover the costs for providing information. She also indicated that <br />Mayor Sonterre would be billed for his data practices request. <br /> <br />10. APPROVAL OF MINUTES <br /> <br />A. January 7, 2002 City Council Minutes. <br /> <br />MOTION/SECOND: Marty/Thomas. To Table Consideration of the Minutes to the Next <br />Council Meeting. <br /> <br /> Ayes – 4 Nays – 0 Motion carried. <br /> <br />Council recessed to the EDA meeting at 11:00 p.m. <br /> <br />Council reconvened at 11:16 p.m. and moved to the closed session. <br /> <br />Mayor Sonterre noted that Council would adjourn from the closed session. <br /> <br />11. CLOSED SESSION TO DISCUSS THREATENED/POTENTIAL LITIGATION <br /> <br />Council recessed to the closed session at 11:16 p.m. <br />
