Mounds View City Council January 28, 2002 <br />Regular Meeting Page 19 <br /> <br />Dr. Belting indicated that the gambling organizations are in tune for a monthly reporting and it <br />would actually be more difficult to change to a quarterly reporting for the City. <br /> <br />Council Member Thomas indicated she would like to approve the ordinance without the 10% <br />fund or the 3% tax. <br /> <br />MOTION/SECOND: Thomas/Marty. To Amend the Ordinance to Remove the 10% Fund and <br />the 3% Tax. <br /> <br /> Ayes – 4 Nays – 0 Motion carried. <br /> <br />MOTION/SECOND: Marty/Thomas. To Waive the Reading, Approve the Second Reading and <br />Adopt Ordinance 691, Amending Chapter 502 (Intoxicating Liquor) and Chapter 503 (3.2 <br />Percent Beer) of the Mounds View Municipal Code as They Relate to Charitable Gambling. <br /> <br />Council Member Stigney indicated he did not feel the Ordinance was in need of change and the <br />City is opening itself up by changing the Ordinance. <br /> <br />Council Member Thomas indicated the Ordinance does not open anything up it simply requires <br />where the money is to be used. <br /> <br />Council Member Stigney indicated the City has no real control of distribution in the City. <br /> <br />Council Member Marty agreed that the Chamber of Commerce would be contributing to the <br />Mounds View/New Brighton area not just the City. He then commented he is concerned that the <br />Ordinance would be weakened and noted Council would need to be vigilant in granting <br />approvals or changes in charitable gambling establishments. <br /> <br />Council Member Thomas indicated that this change gives the City more control over where the <br />money is spent. <br /> <br />Council Member Stigney indicated that the Chamber could distribute its funds in New Brighton <br />and not be in violation of the Ordinance which means the City really has no control. <br /> <br />Council Member Thomas indicated the City has the authority to issue the license and that has <br />nothing to do with whether the organizations are following the Ordinance or not. <br /> <br />Council Member Stigney asked City Attorney Riggs if a license could be withheld because the <br />City does not like how funds are distributed. <br /> <br />City Attorney Riggs indicated the City has ultimate control of licensing. He indicated it was not <br />arbitrary but Council could always change the Ordinance back to what it was. <br /> <br />Dr. Belting indicated that there is a contract that is renewed every two years that is approved by <br />Council.
