Item No: 6G <br />Meeting Date: May 13, 2002 <br />Type of Business: Consent City of Mounds View Staff Report <br />To: Honorable Mayor and City Council <br />From: James Ericson, Community Development Director <br />Item Title/Subject: Set a Public Hearing for 7:15 pm, Tuesday, May 28, <br />2002, to Consider a Preliminary Plat Request from <br />Cedar Management to Combine Properties Located <br />at 7180 and 7190 Silver Lake Road. <br />Date of Report: May 9, 2002 <br /> <br />Background: <br /> <br />Ordinarily the Council does not receive a staff report when setting a public hearing. In <br />this case, I wanted to let the Council know of an issue that the applicant, Cedar <br />Management, would like addressed. <br /> <br />Discussion: <br /> <br />Cedar Management owns and operates the Silverwood Apartments at 7180 and 7190 <br />Silver Lake Road. The complex is currently non-conforming in the sense that it does not <br />meet the area requirements for a 40-unit building. The site consists of 91,936 square <br />feet and they would need 125,000 square feet to be conforming. Cedar Management <br />owns a vacant, land-locked lot adjacent to the existing apartments and they are seeking <br />to “combine” the tow tracts of land to become a legal conforming use. <br /> <br />A lot combination, according to the City Code, is considered a subdivision of land and <br />thus subject to park dedication requirements. In this case, the appropriate fee would be <br />$14,390. The applicant is seeking a waiver from this requirement as they feel the fee is <br />not justified and disproportionate relative to the simple combination.
