<br /> <br />Item No: 7A <br />Meeting Date: July 22, 2002 <br />Type of Business: PH & CB <br />City of Mounds View Staff Report <br /> <br /> <br /> <br />To: Honorable Mayor and City Council <br />From: James Ericson, Community Development Director <br />Item Title/Subject: Public Hearing and Consideration of a request to <br />Remove Lot 2, Block 1, Anthony Properties Addition, <br />from the Theater Planned Unit Development (PUD) <br />Agreement. <br />Date of Report: July 17, 2002 <br /> <br />Background: <br /> <br />Rob and Tony Jacob, owners of the Jake’s Sports Café (Formerly Donatelles an d Knotty <br />Pine) have entered into an agreement to purchase the unimproved office parcel adjacent <br />to Jakes to expand their parking lot. Jake’s currently does not satisfy the City’s parking <br />requirements for a bar / restaurant of its size and as evidence of t hat, often Jake’s <br />parking overflows onto the theater parking lot and onto County Road H2 right of way. <br />Further exacerbating an already difficult parking situation is the City’s planned <br />reconstruction of County Road H2, which will cause an additional loss of at least 13 <br />parking stalls and will force the Jacobs to reconstruct the existing parking lot as a result. <br />The proposed purchase of the adjacent lot will allow Jake’s to expand their parking lot, <br />thereby complying with the City’s parking requirements an d eliminating the overflow <br />parking on the theater’s lot. <br /> <br />Discussion: <br /> <br />The theater development was approved by the City Council on May 11, 1998. The PUD <br />document indicates that the parcel in question, Lot 2, Block 1, be developed as a single - <br />story, 11,000 square foot office building (similar to the office building constructed on the <br />adjoining lot to the east currently leased to the Mounds View School District.) As <br />indicated above, the Jacobs are now in control of the lot and desire to incorporate the lo t <br />into the Jakes site to provide additional parking for the business. While parking is an <br />identified allowed use within the theater PUD, because the lot would not longer be <br />associated with the theater development (and would have no direct access to the th eater <br />development) staff would recommend that the lot be removed from the theater PUD and <br />Developers Agreement to facilitate its incorporation into the Jake’s development. <br /> <br />Ramifications: <br /> <br />Removing this parcel from the theater PUD and developers agreemen t would provide for <br />the ability to utilize the property in a fashion not originally contemplated when the theater <br />PUD was drafted. The implications of this action are that the provisions of the PUD <br />would no longer apply to this parcel, that the Zoning Cod e would apply as if there were no <br />PUD.
