<br /> <br /> <br /> <br /> <br /> <br /> <br />RESOLUTION NO. 5803 <br /> <br /> CITY OF MOUNDS VIEW <br /> COUNTY OF RAMSEY <br /> STATE OF MINNESOTA <br /> <br />A RESOLUTION APPROVING THE REMOVAL OF A PARCEL FROM THE THEATER <br />PLANNED UNIT DEVELOPMENT (PUD) AND DEVELOPMENT AGREEMENT <br /> <br />WHEREAS, Tony and Rob Jacob (the “Jacobs”), owners and operators of the Jake’s <br />Sports Café of Mounds View (“Jakes”) located at 2400 County Road 10, have gained an <br />ownership interest in an adjacent property (the “Property”) within the Theater Development, <br />said Property being legally described as follows: <br /> <br />Lot 2, Block 1, Anthony Properties Addition, <br />Ramsey County <br /> <br />WHEREAS, the City Council approved the development commonly referred to as the <br />“Theater Development” on May 11, 1998; and, <br /> <br />WHEREAS, according to the approved Theater Planned Unit Development (“PUD”), <br />the Property is to be improved with an 11,000 square f oot office building; and, <br /> <br />WHEREAS, it is the intent and desire of the Jacobs to instead construct a parking lot <br />on the Property for the exclusive benefit of and use by Jakes’ patrons; and, <br /> <br />WHEREAS, the Mounds View Planning Commission reviewed this request at their <br />meeting on July 17, 2002 and unanimously supported the motion to remove the Property <br />from the Theater PUD and Development Agreement; and, <br /> <br />WHEREAS, the Mounds View City Council has reviewed the following documents <br />regarding this proposal: <br /> <br />1. Zoning Map <br />2. Location Map <br />3. Parking Plan <br />4. Photographic Documentation <br />5. Staff Report <br /> <br />WHEREAS, the Mounds View City Council held a public hearing relating to this <br />request on July 22, 2002 at which time all interested parties were provided an opportunity <br />to be heard; and, <br />WHEREAS, the City Council is in support of this change of use and in recognition of <br />the fact that the Property would no longer be associated with the theater development,
