<br />Item No: 7B <br />Meeting Date: August 12, 2002 <br />Type of Business: CB <br />City of Mounds View Staff Report <br />To: Honorable Mayor and City Council <br />From: James Ericson, Community Development Director <br />Item Title/Subject: Consideration of the Martin Harstad Request to <br />Rezone 66 Lots within the Red Oak Estates No. 3 <br />Subdivision from R-1, Single Family Residential, to R- <br />3, Medium Density Residential <br />Date of Report: July 16, 2002 <br /> <br /> <br />Introduction <br /> <br />Martin Harstad, representing property owners Keith and Diane Harstad, has requested <br />approval of a rezoning of the 66 undeveloped townhome lots within the Red Oak Estates No. <br />3 subdivision, originally platted in 1974, from R-1, Single Family Residential, to R-3, Medium <br />Density Residential. The request would allow the applicant to construct townhomes on the <br />lots, subject to wetland zoning restrictions. <br /> <br />Discussion <br /> <br />The City Council held a public hearing on July 8, 2002, taking testimony from staff, residents <br />and the applicant. After extensive discussion, the bulk of which surrounded the existing and <br />future drainage and stormwater management issues as well as the difference between an R- <br />2 and R-3 zoning designation and the related development intensities, the Council directed <br />staff to prepare a resolution denying the rezoning request. The Council indicated that one of <br />the reasons for denial, in addition to the reasons articulated by the Planning Commission, <br />would be that they believed twin homes would be more appropriate on County Road H2 than <br />would town home units. <br /> <br />The Council also suggested that the applicant meet with the adjacent property owners in an <br />effort to resolve some of the mitigating and outstanding issues concerning the past and <br />proposed developments before the next meeting. The applicant did meet with a group of <br />residents on Tuesday, July 16, 2002, and while the meeting produced much discussion, <br />nothing of consequence was resolved relating to the development proposal. <br /> <br />Action <br /> <br />As directed, please find attached to this report Resolution 5802, a Resolution denying the <br />requested rezonings of Lots 1-52 and Lots 59-72 of Red Oak Estates #3 based upon the <br />potentially extensive and adverse effects to the surrounding neighborhood, the <br />inconsistencies with the Comprehensive Plan and preference for twinhomes along County <br />Road H2.
