City of Mounds View <br />Page 16 <br />defined in Minnesota Statutes, section 561.01. In determining whether a nuisance exists, <br />consideration shall be given to the kennel's location, location of other residences and general <br />character of the neighborhood. (Ord. 460, 4-24-89; 1993 Code) <br /> <br />Subd. 16. Dogs Running at Large: No person shall allow any dog to run at large within the City of <br />Mounds View. (Ord. 613, 4-13-98) <br /> <br />701.05 PROHIBITED ACTIVITIES: <br /> <br />(1) DISEASED ANIMALS. No person shall keep or allow to be kept on his premises occupied <br />by him, or permit or allow to run at large any diseased animal. <br /> <br />(2) VICIOUS ANIMALS. No person shall keep or allow to be kept on his premises occupied <br />by him, or permit or allow to run at large any vicious animal. <br /> <br />Upon conviction for violation of this section, the court may in addition to imposition of sentence, <br />direct the animal control officer to take the animal into custody and forthwith dispose of it in a <br />humane manner. <br /> <br />(3) CRUELTY TO ANIMALS. No person shall inhumanely, unnecessarily and cruelly or <br />wantonly beat, injure, torment or otherwise abuse an animal or cause or permit an animal fight. <br /> <br />(4) PENALTY. Any person violating any provision of this Chapter shall be guilty of a <br />misdemeanor. <br /> <br />(5) LIABILITY FOR PETS. No pet or animal owner who is exercising due care by adequately <br />restraining or confining their pet or animal shall be held liable, under the ordinance, for any harm <br />his or her pet or animal shall cause to any other animal. This provision shall apply if the harmed <br />animal is running wild or at large and said animal has entered the area or territory of the animal <br />being legally restrained or confined. <br /> <br />701.06: RAISING / KEEPING DOMESTIC ANIMALS DOMESTIC ANIMALS: <br /> <br />Subd. 1. Definitions: When used in this Section, the following words and phrases shall have the <br />meanings ascribed to them in this subdivision: <br /> <br /> a. AT LARGE: Off the premises of the owner. <br /> <br /> b. DOMESTIC FARM ANIMAL: Any cattle, horses, mules, sheep, swine or goats.
