Page 14 City of Mounds View <br />those occupying land within five hundred feet (500’) of the proposed kennel <br />who agree to the establishment of the kennel. Upon the receipt of the <br />petition the council will then set a hearing for a special use permit as <br />provided for in Title 1100 of this <br />Code. The petition shall contain, among other items of information, how <br />many dogs the petitioner intends to keep on the premises. <br /> <br />(b) License fee: The annual license fee for dog kennels shall be established by <br />resolution of the City Council. The license fees are due September 1 of <br />each year. <br /> <br /> b. Licensing Requirements: All dog kennels, residential or commercial, as defined in <br />subdivision 1 of this Section, must be established by a special use permit as required in Title <br />1100 of this Code. The zoning classifications as required under Chapter 1103 and Section <br />1104.02 of this Code must be conformed with. Notwithstanding any provision to the <br />contrary in Title 1100 of this Code, the owner of a proposed dog kennel shall present a <br />petition to the Council signed by over fifty percent (50%) of all registered landowners or <br />those occupying land within five hundred feet (500') of the property to be affected, upon the <br />receipt of which the Council will then set the hearing for the special use permit as provided <br />for in Title 1100 of this Code. The petition shall contain, among other items of information, <br />how many dogs the petitioner intends to keep on the premises. <br /> <br /> c. License Fee: The annual license fee for dog kennels shall be established by resolution of <br />the City Council. Said license fees are due September 1 of each year. <br /> <br /> d. Cleanliness and Order; Nuisance Declared: Kennels and premises used therefor shall be <br />kept in a clean, quiet, orderly and sanitary condition so as not to constitute a nuisance as <br />defined in Minnesota Statutes, section 561.01. In determining whether a nuisance exists, <br />consideration shall be given to the kennel's location, location of other residences and general <br />character of the neighborhood. (Ord. 460, 4-24-89; 1993 Code) <br /> <br />(c) Cleanliness and order; nuisance declared: Kennels and the premises around <br />the kennel shall be kept in a clean, quiet, orderly and sanitary condition so <br />as not to constitute a nuisance as defined in Minnesota Statutes, section <br />561.01. In determining whether a nuisance exists, consideration shall be <br />given to the kennel’s location, location of other residences, and general <br />character of the neighborhood. <br /> <br /> <br />Subd. 16. Dogs Running at Large: No person shall allow any dog to run at large within the City of <br />Mounds View. (Ord. 613, 4-13-98) <br /> <br />701.04: DOMESTIC ANIMALS: <br /> <br />Subd. 1.
