Item No: 10C <br />Meeting Date: January 8, 2001 <br />Type of Business: CB <br />WK: Work Session; PH: Public Hearing; <br />CA: Consent Agenda; CB: Council Business <br />City of Mounds View Staff Report <br />To: Honorable Mayor & City Council <br />From: James Ericson, Planner <br />Item Title/Subject: First Reading and Introduction of Ordinance 672, an <br />Ordinance Amending Chapter 1106 of the Mounds <br />View Zoning Code Pertaining to Home Occupations <br />Date of Report: January 4, 2001 <br /> <br /> <br />Background: <br /> <br />This ordinance has been drafted to update Section 1106.03 of the Mounds View <br />Zoning Code pertaining to Home Based Businesses. As the Council is aware, the <br />Planning Commission had reviewed this ordinance in October of last year and <br />forwarded its recommendation of approval to the Council for its action on November <br />13, 2000. At that meeting, the Council heard testimony from the residents and home- <br />based business owners requesting that the Code be changed to allow non-resident <br />employees. Because the Planning Commission had not addressed that issue, the <br />Council returned the ordinance to the Planning Commission for further review. <br /> <br />At their meeting on December 6, 2000, the Planning Commission reconsidered the <br />ordinance and took considerable testimony from the public, reviewed a summary of e- <br />mailed responses on the topic and came to a majority consensus as to how the <br />ordinance should be drafted in light of the new information. On December 20, 2000, <br />the Commission adopted Resolution 643-00 which recommended City Council <br />approval of the revised ordinance. <br /> <br /> <br />Discussion: <br /> <br />As to the issue of allowing employees, a majority of the Planning Commission <br />concluded that it saw no reason to change the ordinance to allow employees, citing <br />concerns from residents and the potential for changing the essential nature of a <br />neighborhood. A majority of the e-mailed responses and those who spoke out at the <br />last meeting also had concerns regarding on-street parking associated with a home <br />occupation. Based on that, the Commission chose to modify its original version <br />concerning parking to disallow on-street parking altogether yet retained the change <br />that dropped the limitation on the number of vehicles that could be parked off-street, <br />so long as the vehicles were parked in compliance with the City’s nuisance codes. <br />Otherwise, the Planning Commission agreed to keep the ordinance as it had originally <br />recommended for approval.
