Sollenberger <br /> City Manager <br /> President, Minnesota City Management Association <br /> City Hall <br /> 4TH & LaFayette St. <br /> Winona, Minn. 55987 <br /> Dear Mr. Sollenberger: <br /> have been informed that a reviewal of the Home Rule Charter provision <br /> for our Clerk/Administrator position, will be conducted by a committee <br /> of the Minnesota City Management Association. <br /> I am requesting information that will enlighten me as to who requested, <br /> or on what basis, the forthcoming reviewal has been initiated. If the <br /> proposed reviewal was requested by an individual , or private parties, <br /> further communications between you and myself may prove beneficial to <br /> all concerned. However, if such reviewal is standard procedure, when <br /> a member' s unit of government changes in structure, then I further <br /> request a co-current opinion, in reference to our past "Clerk/Administrator" <br /> eligibility, under the former status of Statutory City Plan "A" . <br /> (Find enclosed, a copy of the ordinance for this position that was in <br /> effect under the former plan. ) <br /> Obviously, every Administrator employed by Plan "A" cities would be <br /> ineligible, if the precise status of "Manager Form" were required in <br /> determining eligibility for membership in your organization. Therefore, <br /> clarification of criteria used, by the Management Association, to <br /> determine eligibility for membership under Plan "A" , would become bene- <br /> ficial in deliberation of our new Charter provision for the office of <br /> Clerk/Administrator. <br /> To conclude, it is my considered opinion that a comparison ruling must <br /> be rendered, in the interest of credibility regarding the Minnesota <br />
