Citizens Requests and Comments on Items Not on the Agenda <br /> <br />Mayor Linke addressed the Commission and expressed concern that a Planning Commissioner <br />had commented at the last meeting in a negative manner against the Council. He then explained <br />he did not like how the statement was worded and explained to the Commission what their job is <br />and asked whether Mr. Zwirn was willing to abide by the Comprehensive Plan and City Code. <br /> <br />Mayor Linke indicated that Council was told by its legal counsel that the preliminary plat must <br />be approved if all the conditions are met or the City would be sued. He then said that no one on <br />the Council is in favor of this development and he personally feels that the development will be <br />cost prohibitive. <br /> <br />Commissioner Zwirn indicated that he is willing to abide by the Comprehensive Plan and the <br />City Code but reserves the right to disagree with Council decision. <br /> <br />The Commission discussed the requirements for approval of preliminary plats and asked Staff to <br />clarify the requirements to ensure there will be no misunderstandings. <br />______________________________________________________________________________ <br /> <br />5. Special Planning Case SP-121-03 <br /> <br />Community Development Director Ericson suggested leaving the duration of the permit open to <br />allow for consideration of the applications on a case by case basis. <br /> <br />Director Ericson corrected the language to read 180 days rather than annually. <br /> <br />Commissioner Miller asked if Staff checked with the attorney on penalty language. <br /> <br />Director Ericson indicated that the City Attorney asked that the misdemeanor language of the <br />Code stand on this. <br /> <br />Commissioner Hegland asked that the fire code language be added. <br /> <br />MOTION/SECOND: Miller/Scotch. To Approve Resolution 752-04, a Resolution <br />Recommending Approval of a Code Amendment to the Zoning Code Regarding Temporary <br />Structures in Commercial/Industrial Zoning Districts. <br /> <br /> Ayes – 6 Nays – 0 Motion carried. <br />______________________________________________________________________________ <br /> <br />6. Special Planning Case SP-113-02 <br /> <br />The Commission asked that hours of operation be added from 7:00 a.m. to 10:00 p.m. <br />
