<br />. <br /> <br />. <br /> <br />. <br /> <br />RESOLUTION NO. 341-92 <br /> <br />CITY OF MOUNDS VIEW <br />COUNTY OF RAMSEY <br />STATE OF MINNESOTA <br /> <br />RESOLUTION RECOMMENDING DENIAL OF THE REQUEST BY <br />LONNIE MADISON FOR A CONDITIONAL USE PERMIT TO ALLOW A <br />RESIDENTIAL DOG KENNEL ON HIS PROPERTY AT 5200 JEFFERY DRIVE <br />PLANNING CASE NO. 339-91 <br /> <br />WHEREAS, the Mounds View Planning Commission has reviewed <br />the request of Lonnie Madison for a Conditional Use Permit to allow <br />the establishment of a residential dog kennel at 5200 Jeffery <br />Drive; and <br /> <br />WHEREAS, the Planning commission has reviewed the Mounds <br />View Municipal Code and recognizes that the Code allows for <br />residential dog kennels with a Conditional Use Permit; and <br /> <br />WHEREAS, Chapter 40.25 Subdivision C (1-6) outlines the <br />criteria by which all Conditional Use Permit requests are reviewed. <br /> <br />WHEREAS, past complaints on the site have not been <br />remediated; four complaints have been received in the past year. <br /> <br />NOW, THEREFORE BE IT RESOLVED that the Mounds View <br />Planning Commission recommends to the City Council denial of the <br />requested Conditional Use Permit based upon the following: <br /> <br />1. Control and restraint of animals continues to be a <br />problem on the kennel site. <br /> <br />BE IT FINALLY RESOLVED that the Planning Commission <br />directs Staff to forward this resolution to the City Council prior <br />to approval of the minutes. <br /> <br />Adopted this 15th day of July, 1992. <br /> <br />(ATTEST) <br /> <br /> <br />(SEAL) <br /> <br />/::7 /~ L <br />
