<br />Mounds View Planning Commission January 19, 2000 <br />Regular Meeting Page 3 <br /> <br /> <br />recommend the item be tabled until the February 2, 2000 meeting of the Planning Commission. <br />He indicated that if no word is received from the applicant by that meeting date, staff will draft a <br />resolution to deny the request. He noted that the applicant might also withdraw his application, <br />or request Planning Commission action, however, this is still undetermined. <br /> <br />Commissioner Miller inquired if the applicant could request an extension of time. <br /> <br />Planning Associate Ericson stated this was correct. He explained that the Planning Commission <br />could also extend the matter for an additional 60 days, without concern that it might be approved <br />accidentally, by virtue of non-action on the part of the City. He advised that the City is required <br />to act upon all planning requests within 60 days, unless that time frame is extended, and the <br />Commission could extend this matter for an additional 60 days. He reiterated that further <br />information regarding how this matter will proceed should be available by the end of the week. <br /> <br />MOTION/SECOND: Stevenson/Kaden. Planning Case No. 579-99 <br /> <br />Property involved: 4749 Old Highway 8 <br />Consideration of Resolution 603-00, a resolution approving a front-yard setback variance for the <br />building located at 4749 Old Highway 8. <br />Applicant: ASC Properties, LLC. <br /> <br /> <br />The applicant was not present. <br /> <br />Planning Associate Ericson gave the staff report as follows: <br /> <br />This item is a request for a variance to allow for a reduced front yard setback for an office- <br />warehouse building located at 4749 Old Highway 8. The applicant, ASC Properties, LLC is the <br />new owner of the subject property, which is in the process of changing hands. An application <br />for variance has been requested in order to provide for a clean transfer of the property. <br /> <br />Planning Associate Ericson advised that a variance is required because the building, according to <br />a recent survey, encroaches into the front yard setback by approximately 2 to 3 feet, on the north <br />end of the property. He noted that the property curves slightly, therefore, the building maintains <br />the required 40-foot setback toward the south end of the property. <br />
