Placing shrubs and trees as outlined in David Licht's <br />report outside of the play area. <br /> <br />4. If the City Engineer approves, the proposed 24 foot <br />wide curb cut is acceptable rather than 22 foot <br />required for residential property. <br /> <br />5. The developer shall install a noise barrier in the <br />future according to state standards if the noise is <br />above state standards. <br /> <br />6. The Comprehensive Plan should be amended. <br /> <br />7. Screening, trees and vegetation shall be provided <br />according to David Licht's report. <br /> <br />8. Provide screening and install all landscaping according <br />to David Licht's memorandum. <br /> <br />9. Move the trash enclosure 15 feet to the west according <br />to David Licht's memorandum and City Ordinance which <br />specifies a 55 foot length for a loading berth. <br /> <br />10. Additional landscaping shall be provided as indicated <br />in Exhibit E of David Licht's letter. <br /> <br />11. The variance is to exempt the parking and loading area <br />from setback requirements; <br /> <br />12. The principal structure must be insulated for sound <br />according to federal and state standards. <br /> <br />BE IT FURTHER RESOLVED that a development agreement be <br />entered into between the City and the Developer which includes <br />the following provisions: <br /> <br />a) Exhibits: <br /> <br />1. Site, Grading and Utility plan <br />2. Site, Development and Landscape Plan <br />3. Site Survey <br />4. Legal Description <br />5. Ordinance No. 49A 7-Year Peformance Bond <br />of $1,000.00 <br />6. Building Plans and Specifications <br /> <br />b) Security for the development in an amount to be <br />determined. <br /> <br />c) Exhibit 2A to require the following: <br /> <br />1. Payment of all City expenses above and beyond <br />amounts previously submitted. <br />
