<br />. <br /> <br />. <br /> <br />. <br /> <br />MOUNDS VIEW PLANNING COMMISSION <br />RESOLUTION NO. 161-86 <br /> <br />CITY OF HOUNDS VIEW <br />COUNTY OF RM1SEY <br />STATE OF MINNESOTA <br /> <br />RECOMMENDATION TO THE CITY COUNCIL REGARDING MOUNDS VIEW <br />PLANNING CASE 168-85, HERBST AND SONS DEMOLITION COMPANY <br /> <br />WHEREAS, Herbst and Sons Demolition Company has requested <br />City approval for a major subdivision (I lot into 3 lots), <br />rezoning and variance; and <br /> <br />WHEREAS, the Planning Commission has reviewed the staff <br />report and reviewed information submitted by the applicant; and <br /> <br />WHEREAS, the Planning Commission has also reviewed the <br />proposal and it is in conformance with all Chapters of the <br />Municipal Code, specifically Chapters 40, 42, 49, and 49A and <br />State Statutes; and <br /> <br />WHEREAS, the existing building is 5 feet from the property <br />line, and the City Code requires a 20 foot setback from side yard <br />lot lines and this is a pre-existing condition not caused by the <br />property owners; <br /> <br />NOW, THEREFORE, BE IT RESOLVED that the Mounds View <br />Planning Commission recommends rezoning the property, occupied by <br />Herbst and Sons after the subdivision, from B-3 to I-I; <br /> <br />BE IT FURTHER RESOLVED that the Mounds View Planning <br />Commission recommends that the property now occupied by Pettibone <br />Corporation be rezoned from B-3 to I-I at the same time; <br /> <br />BE IT FURTHER RESOLVED that the Mounds View Planning <br />Commission grants a variance of 15 feet on the side yard setback <br />requirement; <br /> <br />BE IT FURTHER RESOLVED that the Mounds View Planning <br />Commission recommends revising the Comprehensive Plan for the <br />Herbst and Pettibone properties; <br /> <br />BE IT FINALLY RESOLVED that the Mounds View Planning <br />Commission direct staff to forward this resolution to the City <br />Council prior to approval of the minutes. <br /> <br />Adoped this 7th day of May, 1986. <br /> <br />ATTEST~ <br /> <br />~Z~/i ,_,~;1 (J /kz~z7:::, <br />Ch~; ~ <br /> <br />Di rector of Publ ic Works/ <br />Conoounity Development <br /> <br />(SEAL) <br />
