<br />. <br /> <br />. <br /> <br />. <br /> <br />RESOLUTION NO. 217-88 <br /> <br />CITY OF HOUNDS VIEH <br />COUNTY OF RAHSEY <br />STATE OF IlINNESOTA <br /> <br />RESOLUTION DENYING A VARIANCE REQUEST FOR DYNAMIC <br />DESIGNERS, 7656 AND 7660 HOODLAHN DRIVE, <br />HOUNDS VIEH PLANNING CASE NO. 138-83 <br /> <br />WHEREAS, Chapter 48 of the Hunicipal Code sets require- <br />ments for building within a wetland; and <br /> <br />WHEREAS, Dynamic Designers have requested variances and a <br />conditional use permit to build two fourplexes within Wetland 1-9 <br />and the 100 foot buffer; and <br /> <br />~lliEREAS, there is a discrepancy between the lot size <br />scaled off on the site plan dated January 12, 1988, and that of <br />the Ramsey County records; and <br /> <br />\lliEREAS, the existing proposal would require the following <br />variances: <br /> <br />1) Waive the minimum lot size for subdivision in a <br />wetland zoning district. <br /> <br />2) Waive the minimum lot footage for subdividing within a <br />wetland zoning district. <br /> <br />3) Haive the requirement that all structures shall be set <br />back at least 100 feet from a designated wetland. <br /> <br />WHEREAS, the existing proposal also needs a conditional <br />use permit for filling within a flood plain and a wetland altera- <br />tion permit to change the wetland boundaries, and <br /> <br />vJHEREAS, Staff, City Consultants and the Planning Commis- <br />sion have extensively reviewed the proposed development; and <br /> <br />WHEREAS, the Hounds View Hunicipal Code 40.26, Subd. D, <br />states the criteria for granting a variance; and <br /> <br />WHEREAS, there are no extraordinary circumstances as <br />presented which apply to the property which do not apply to other <br />properties in a wetland zoning district; <br /> <br />NOH, THEREFORE, BE IT RESOLVED that the Hounds View <br />Planning Commission denies Dynamic Designers' request for a <br />variance from lot size and lot width requirements in a wetland. <br /> <br />Adopted this 16th day of Ilarch, 1988. <br /> <br />ATTEST: <br /> <br /> <br />(SEAL) <br />
