RESOLUTION NO. 224-88 CITY OF HOUNDS VIEH COUNTY OF RAr1SEY STATE OF fIINNESOTA RESOLUTION ArlENDING PLANNING CmmISSION RESOLUTION NO. 217-88 DENYING A VARIANCE FOR DYNAflIC DESIGNERS, 7656/7660 HOODLAUN DRIVE, rlOUNDS VIEW PLANNING CASE NO. 138-83 HHEREAS, Chapter 48 of the Hunicipal Code sets require- ments for building within a wetland; and \lliEREAS, Dynamic Designers have requested variances and a conditional use perQit to build two fourplexes within Hetland 1-9 and the 100 foot buffer; and WHEREAS, there is a discrepancy between the lot size scaled off on the site plan dated January 12, 1988, and that of the Ramsey County records; and WHEREAS, the existing proposal would require the following variances: 1) Waive the minimum lot size for subdivision in a wetland zoning district. 2) Haive the minimuQ lot width as measured at the building setback line for subdividing within a wetland zoning district. 3) lJaive the requirement that all structures shall be set back at least 100 feet from a designated wetland. \lliEREAS, the existing proposal also needs a conditional use permit for filling within a flood plain and a wetland altera- tion permit to change the wetland boundaries, and WHEREAS, Staff, City Consultants and the Planning Commis- sion have extensively reviewed the proposed development; and WHEREAS, the flounds View rlunic ipal Code 40.26, Subd. D, states the criteria for granting a variance; and WHEREAS, there are no extraordinary circumstances as presented which apply to the property which do not apply to other properties in a wetland zoning district; NOW, THEREFORE, BE IT RESOLVED that the Hounds View Planning Commission denies Dynamic Designers' request for a variance from lot size and lot width requirements in a wetland.
