<br />. <br /> <br />. <br /> <br />. <br /> <br />MOUNDS VIEW PLANNING COMMISSION <br />RESOLUTION NO. 265-89 <br /> <br />CITY OF MOUNDS VIEW <br />COUNTY OF RAMSEY <br />STATE OF MINNESOTA <br /> <br />RESOLUTION RECOMMENDING APPROVAL OF MOUNDS VIEW SQUARE <br />PROPOSED REZONING, CONCEPTUAL STAGE CONDITIONAL USE PERMIT/ <br />PLANNED UNIT DEVELOPMENT AND CONDI'rIONAL USE PERMIT <br />FOR A HARDEE'S CONVENIENCE FOOD RESTAURANT, <br />PLANNING CASE NO. 276-89 <br /> <br />WHEREAS, the Planning Commission has reviewed the <br />requested rezoning from B-4 to B-3, conceptual stage <br />CondItional Use Permit/Planned Unit Development and <br />CondItIonal Use Permit for the convenIence food restaurant <br />to be located at the Mounds View Square Shopping Center site <br />(PIN 07-30-23-11-0001). <br /> <br />WHEREAS, the Planning Commission has reviewed the <br />proposed rezonIng request as a separate Issue from the sIte <br />development plans; and <br /> <br />WHEREAS, the Planning CommissIon has reviewed the <br />criteria for all proposed rezonings; and <br /> <br />WHEREAS, the Planning CommissIon has determined that <br />the proposed rezoning is in conformance with the <br />Comprehensive Plan; and <br /> <br />WHEREAS, the PlannIng CommIssion has determIned that <br />the proposed rezonIng WIll not have an adverse impact on the <br />surroundIng properties; and <br /> <br />WHEREAS, the Planning CommissIon has reviewed the <br />geographical area Involved; and <br /> <br />WHEREAS, the PlannIng CommIssion has determIned the <br />proposed use will not tend to or actually depreciate the <br />area in WhICh It IS proposed; and <br /> <br />WHEREAS, the Planning CommIssion has taken Into <br />consideratIon the character of the surrounding area; and <br /> <br />WHEREAS, the Planning Commission has determined <br />that the applIcant has demonstrated a need for such use; and <br /> <br />WHEREAS, the Planning Commission has revIewed the <br />requested conceptual stage CondItional Use Permit/Planned <br />Unit Development to allow for the addition of another <br />prIncipal building on this site; and <br />
