<br />i <br /> <br />. <br /> <br />. <br /> <br />. <br /> <br />MOUNDS VIEW PLANNING COMMISSION <br />RESOLUTION NO. 282-90 <br /> <br />CITY OF MOUNDS VIEW <br />COUNTY OF RAMSEY <br />STATE OF MINNESOTA <br /> <br />RESOLUTION DENYING VARIANCE REQUEST BY PHILLIPS 66 <br />FOR CURB CUT LOCATION SETBACK, 2525 HIGHWAY 10, <br />PLANNING CASE NO. 288-90 <br /> <br />WHEREAS, the Planning Commission has reviewed the <br />request by Phillips 66 Company for a variance from the curb <br />cut location setback requirements; and <br /> <br />WHEREAS, the Planning Commission has reviewed and taken <br />into consideration the applicant's hardship statement as <br />required for a variance request; and <br /> <br />WHEREAS, the Planning Commission has reviewed the <br />zoning ordinance section requiring fifty (50) feet from the <br />intersection of lot lines; and <br /> <br />WHEREAS, the Planning Commission has reviewed the City <br />Engineer's recommendation to relocate the Long Lake Road <br />access to Bronson Drive; and <br /> <br />WHEREAS, the Planning Commission has reviewed and taken <br />into consideration the City Attorney's opinion of the hardship <br />statement presented by the applicant as outlined in the <br />Planning Commission minutes of March 7, 1990; and <br /> <br />WHEREAS, the Planning Commission has reviewed the <br />criteria for granting a variance per Section 40.26; and <br /> <br />WHEREAS, the Planning Commission has considered <br />alternatives to the proposed site plan; and <br /> <br />WHEREAS, the Planning Commission determines that there <br />are reasonable alternatives to the proposed site plan. <br /> <br />NOW, THEREFORE, BE IT RESOLVED that the Planning <br />Commission of the City of Mounds View denies the variance <br />request for the following reasons: <br /> <br />1. The Planning Commission finds that no hardship <br />exists. <br />2. Action is supported by City Attorney's letter.' <br />3. Bronson Drive provides greater safety. <br />
