<br />. <br /> <br />'. <br /> <br />. <br /> <br />~ <br /> <br />MOUNDS VIEW PLANNING COMMISSION <br />RESOLUTION NO. 289-90 <br /> <br />CITY OF MOUNDS VIEW <br />COUNTY OF RAMSEY <br />STATE OF MINNESOTA <br /> <br />RESOLUTION APPROVING VARIANCE SETBACK REQUEST BY <br />KUNZ OIL, 2280 COUNTY ROAD I, PLANNING CASE NO. 295-90 <br /> <br />WHEREAS, the site plan is attached and shown as Exhibit <br />A and dated April 16, 1990; and <br /> <br />WHEREAS, the Planning Commission has reviewed the <br />applicant's request for a variance from the side yard setback <br />to allow the construction of a temporary accessory building on <br />the site at 2280 County Road I; and <br /> <br />WHEREAS, the accessory building would be used only for <br />the purpose of housing the contamination clean up equipment; <br />and <br /> <br />WHEREAS, the building would be removed once the <br />contamination clean up is completed; and <br /> <br />WHEREAS, the Planning Commission has reviewed the <br />criteria used when evaluating all variance requests; and <br /> <br />WHEREAS, the Planning Commission determines that the <br />requested variance meets the evaluation criteria; and <br /> <br />WHEREAS, the Planning Commission determines that a <br />situation exists on the property that affects the general <br />health, safety and welfare of the community. <br /> <br />NOW, THEREFORE, BE IT RESOLVED that the Planning <br />Commission approves the variance request based on the <br />following: <br /> <br />1. The building is temporary in nature. <br /> <br />2. Documentation will be supplied to the City from <br />the Minnesota Pollution Control Agency when the <br />clean up has been completed. <br /> <br />3. The clean up will be completed by May, 1993. <br /> <br />4. If the clean up takes longer than anticipated, a <br />time extension may be applied for. <br /> <br />5. <br /> <br />The monitor wells will remain in place after the <br />clean up. <br />
