<br />. <br /> <br />. <br /> <br />. <br /> <br />MOUNDS VIEW PLANNING COMMISSION <br />RESOLUTION NO. 322-91 <br /> <br />CITY OF MOUNDS VIEW <br />COUNTY OF RAMSEY <br />STATE OF MINNESOTA <br /> <br />RESOLUTION APPROVING THE REQUESTED DRIVEWAY <br />OPENING VARIANCE FOR PHILLIPS 66 COMPANY, <br />2525 HIGHWAY 10, PLANNING CASE NO. 329-91 <br /> <br />WHEREAS, the Mounds View Planning Commission has <br />reviewed the request of Phillips 66 Company for a variance to <br />allow a 40 foot driveway opening where only a 30 foot opening is <br />allowed by Code; and <br /> <br />WHEREAS, the Planning Commission has reviewed the <br />criteria used when evaluating all variance requests; and <br /> <br />WHEREAS, the Planning Commission has considered that <br />the reason for the variance request is that the City has <br />requested a 10 foot easement from the applicant. <br /> <br />NOW, THEREFORE, BE IT RESOLVED that the Mounds View <br />Planning Commission approves the driveway opening variance <br />request based on the following: <br /> <br />1. The condition that exists is not self-created. <br />2. The requested variance is the minimum needed to <br />alleviate the problem. <br />3. No reasonable alternative for the location of the <br />driveway opening exists. <br /> <br />BE IT FURTHER RESOLVED that any landscaping not <br />requlrlng relocation along Bronson Drive be maintained in its <br />present condition. <br /> <br />Adopted this 18th day of September, 1991. <br /> <br />ATTEST: <br /> <br /> <br />/ <br />~. <br /> <br />( SEAL) <br /> <br />Pl~;r // /9 /~ i, <br />
