<br />. <br /> <br />. <br /> <br />. <br /> <br />PLANNING COMMISSION <br />RESOLUTION NO. 362-93 <br /> <br />CITY OF MOUNDS VIEW <br />COUNTY OF RAMSEY <br />STATE OF MINNESOTA <br /> <br />RESOLUTION REITERATING THE STANCE OF THE MOUNDS VIEW <br />PLANNING COMMISSION REGARDING THE REQUEST FOR VARIANCE OF SIMON <br />T. SIMON, 2840 HIGHWAY 10, PLANNING CASE NO. 358-92 <br /> <br />WHEREAS, Mr. Simon T. Simon made application for a <br />variance to allow a reduction in the required number of off- <br />street parking spaces at 2840 Highway 10; and <br /> <br />WHEREAS, the Mounds View Planning Commission reviewed <br />the request and failed to approve it by the required two-thirds <br />affirmative vote thereby rendering a decision of denial; and <br /> <br />WHEREAS, 'Mr. Simon, as allowed by the Municipal Code, <br />appealed the decision of the Planning Commission to the City <br />Council; and <br /> <br />WHEREAS, the Mounds View City Council reviewed the <br />applicant's request and suggested that an attempt be made to <br />secure an easement from the Minnesota Department of <br />Transportation (MnDOT) for the purposes of providing additional <br />off-street parking on the site; and <br /> <br />WHEREAS, the applicant secured the requested easement <br />from MnDOT; and <br /> <br />WHEREAS, based upon the securing of the easement, the <br />Mounds View City Council referred the request back to the <br />Planning commission for reconsideration; and <br /> <br />WHEREAS, the Mounds View Planning Commission has <br />reconsidered the request as directed by the City Council; and <br /> <br />WHEREAS, the Mounds View Planning Commission finds that <br />the request is not significantly different from the original <br />request for the following reason: The new request can provide for <br />a maximum of 21 parking spaces versus 17 under the original <br />request which is significantly less than the required 34 spaces; <br />and <br /> <br />WHEREAS, the Planning Commission has. reviewed the <br />easement agreement secured by the applicant and has determined <br />that it is not viable as it allows for the cancellation of the <br />agreement by either party with 60 days written notice. <br /> <br />NOW, THEREFORE, BE IT RESOLVED that based upon the <br />findings listed above, the Mounds View Planning Commission denies <br />
