<br />. <br /> <br />MOUNDS VIEW PLANNING COMMISSION <br />RESOLUTION NO. 363-93 <br /> <br />CITY OF MOUNDS VIEW <br />COUNTY OF RAMSEY <br />STATE OF MINNESOTA <br /> <br />RECOMMENDATION TO THE CITY COUNCIL REGARDING <br />CONDITIONAL USE PERMIT AND VARIANCE REQUEST BY GATEWAY FOODS, <br />2390 HIGHWAY 10, MOUNDS VIEW PLANNING CASE NO. 362-93 <br /> <br />WHEREAS, Gateway Foods has requested City approval <br />to construct an automated car wash in the City of Mounds View; <br />and <br /> <br />WHEREAS, the Zoning Ordinance allows car wash uses <br />in the B-3, Highway Commercial District; and <br /> <br />WHEREAS, the development, as proposed, requires a <br />conditional use permit and variance; and <br /> <br />WHEREAS, the Planning Commission has reviewed the <br />following document regarding this development proposal: <br /> <br />. <br /> <br />a) <br /> <br />site Plan Dated June 15. 1993 <br />(shown as boundary and topography survey) <br /> <br />WHEREAS, the Planning Commission has determined that <br />the conditional use permit request is in conformance with the <br />requirements of the Municipal Code, specifically Chapters 40, <br />42, 49 and 49A and State Statutes; and <br /> <br />WHEREAS, the Planning commission has determined that <br />the requested variance to allow placement of a structure 20 <br />feet from an adjacent residential property where 40 feet is <br />required by Municipal Code does not meet the minimum necessary <br />requirements for hardship. <br /> <br />NOW, THEREFORE, BE IT RESOLVED that the Mounds View <br />Planning Commission recommends denial of the conditional use <br />permit and variance request based upon the following: <br /> <br /> 1. No hardship has been presented by the <br /> applicant. <br /> 2 . Reasonable use of the property does exist. <br /> 3 . The request for variance is not unique to this <br /> property. <br />. 4. The need is self created by the applicant. <br />
