<br />. <br /> <br />. <br /> <br />. <br /> <br />MOUNDS VIEW PLANNING COMMISSION <br />RESOLUTION NO. 487-96 <br /> <br />CITY OF MOUNDS VIEW <br />COUNTY OF RAMSEY <br />STATE OF MINNESOTA <br /> <br />RESOLUTION RECOMMENDING APPROVAL OF A CONDITIONAL USE PERMIT <br />FOR OUTDOOR SALES OF CHRISTMAS TREES AT MOUNDS VIEW SQUARE <br />SHOPPING CENTER, 2535 HIGHWAY 10; PLANNING CASE NO. 467-96. <br /> <br />WHEREAS, Warren Schroer of Land Patterns Landscaping has applied for a conditional <br />use permit to allow outdoor sale of Christmas trees from November 29 to December 25 in the <br />parking lot for the Mounds View Shopping Center at 2535 Highway 10, which property is zoned <br />B-4 and is described as follows: <br /> <br />Part lying northeasterly of the centerline of State Trunk Highway 10 of NE 1/4 <br />of N1/4 (Subject to Roads and Highways) in Section, 7, Township 30, Range 23 <br /> <br />WHEREAS, the Mounds View Zoning Code allows open and outdoor sales in the B-4 <br />Regional Business Zoning District with the approval of a conditional use permit; and, <br /> <br />WHEREAS, the Planning Commission has reviewed the following documents regarding <br />this proposal: <br /> <br />a. Zoning Map <br />b. Planning Application <br />c. Diagram illustrating proposed layout <br />d. Letter of Request <br />e. Certificate of Insurance <br />f Lease Agreement with Paster Enterprises <br /> <br />WHEREAS, the Planning Commission makes the following findings that the criteria for <br />approval in Section 1115.04. Subd. 2 has been met: <br /> <br />a. Outdoor scrvicc, sales and cquipment rental conncctcd with thc principal use is limitcd to <br />thirty percent (30%) ofthc gross floor arca ofthc principal usc. <br /> <br />The shopping center contains 102,035 square feet of building area. The applicant <br />proposes to occupy 1600 square feet in the parking lot, which is 1.6% in comparison to <br />the building square footage on the site. This criteria is met. <br /> <br />b. <br /> <br />Outside sales arcas are fenccd or screened from view of neighboring rcsidential uses or an <br />abutting residcntial district in compliance with subdivisions 1103.08(1) through (5) of this <br />Title. <br />
