<br />. <br /> <br />. <br /> <br />. <br /> <br />Planning Commission Resolution 530-97 <br />Variance Request of Steve & Laura LaUrez <br />September 17, I 997 <br />Page 2 <br /> <br />WHEREAS, the literal interpretation of the provisions of the City Code does 1Iot deprive <br />the applicants of rights commonly enjoyed by other properties in the same district; and <br /> <br />WHEREAS, the conditions which necessitate the variance request have been caused by <br />the applicants in thaI the applicants contracted to have the work accomplished; and <br /> <br />WHEREAS, granting this variance requested will confer on the applicants a special <br />privilege that is denied by this Title to owners of other lands, structures or buildings in the same <br />district in that driveway curb cuts are limited to 22 feet in width in single family residential <br />districts; and, <br /> <br />WHEREAS, the variance lVOltld be materially detrimental to the purpose of this Title and <br />to other properties in the same zone in Ihat driveway curb cut would be fifty percent wider than <br />what is allowed by Code. <br /> <br />NOW, THEREFORE, BE IT RESOLVED, that the Mounds View Planning Commission <br />acting as the Board of Adjustment and Appeals denies the variance request of Steve and Laura <br />Lattrez, residing at 8419 Spring Lake Road. <br /> <br />Adopted this 17th day of September, 1997 <br /> <br />~ ?"L <br /> <br />Jerry ete on, Chairman <br /> <br />ATTEST <br /> <br />~~ <br /> <br />James Ericson, <br />Acting Community Development Director <br /> <br />.
