<br />e <br /> <br />. <br /> <br />. <br /> <br />MOUNDS VIEW PLANNING COMMISSION <br />RESOLUTION NO. 547-98 <br /> <br />CITY OF MOUNDS VIEW <br />COUNTY OF RAMSEY <br />STATE OF MINNESOTA <br /> <br />RESOLUTION APPROVING A REDUCTION IN THE FRONT SETBACK <br />REQUIREMENT FROM 54 FEET TO 37.4 FEET FOR CONSTRUCTION <br />OF A FOYERlENTRYWAY AT 2824 WOODALE DRIVE; <br />PLANNING CASE NO. 524-98 <br /> <br />WHEREAS, the Mounds View Planning Commission has reviewed the request of Ron <br />and Jan Overton to allow a 37.4-foot front setback where 54 feet is required, for the construction <br />of a finished entryway/foyer at 2824 W oodale Drive; and, <br /> <br />WHEREAS, this property is zoned R-l, Single Family Residential District and is legally <br />described as: <br /> <br />Lot 93, KnollwoOll Park, Ramsey County, Minnesota <br /> <br />WHEREAS, the Planning Commission has reviewed the following documents associated <br />with this request: <br /> <br />1. <br />2. <br />3. <br />4. <br />5. <br />6. <br />7. <br /> <br />Planning Application <br />Zoning Map <br />Site Plan <br />Letter from the Applicant <br />Letter from J oAnn Valley <br />Letter from David Rudnik <br />Encroachment Map <br /> <br />WHEREAS, the applicable front setback for this property is 54 feet, which is based upon <br />the house that is closest to the street on this particular block offour homes; and, <br /> <br />WHEREAS, Section 1104.01, Subdivision 3 of the City Code protects the uniformity and <br />continuity of homes set back further than the required minimum 30-foot front yard setback; and, <br /> <br />WHEREAS, the literal interpretation of the provisions of this Title would deprive the <br />applicant of rights enjoyed by other owners of homes in the same district that are set back further <br />than the required 30 feet, so long as there is a property within that same block that sits closer to <br />the street; and, <br /> <br />WHEREAS, granting the variance requested will not confer on the applicant any special <br />privilege that is denied by this Title to owners or other lands, structures or buildings in the same <br />district in that house additions are typical improvements for single family residences; and, <br />
