<br />. <br /> <br />. <br /> <br />. <br /> <br />Resolution 613-00 <br />Sysco Variance <br />April 19, 2000 <br />Page 2 <br /> <br />WHEREAS, a public hearing was held Wednesday, April 19, 2000, with regard to this <br />variance request; and, <br /> <br />WHEREAS, according to Section 1125.02, Subdivision 2 of the Mounds View <br />Municipal Code, the Planning Commission is to review a standard set of criteria, of which all <br />must be satisfied, in order to grant a variance to the Zoning Code. <br /> <br />NOW, THEREFORE, BE IT RESOLVED, the Mounds View Planning Commission <br />has reviewed the criteria identified in Section 1125.02, Subdivision 2 of the Mounds View <br />Municipal Code and makes the following findings of fact: <br /> <br />I. Exceptional or extraordinary circumstances apply to 2400 County Road J in that the <br />existing parking lot and truck circulatory system effectively prohibits the siting of a <br />billboard in a location consistent with the requirements of the Code. <br /> <br />2. A deprivation to the property owner exists in that the literal interpretation of the Code <br />would prohibit the siting of two billboards which would otherwise meet the Code <br />requirements were it not for the location and configuration of the parking lot. <br /> <br />3. The applicant was not involved in the drafting of the ordinance which conditionally allows <br />the installation of billboards on properties north of State Highway 10. Its business and the <br />associated site development and improvements had occurred long before the contemplation <br />of such an ordinance. Had the ordinance been in effect prior to the Sysco development, the <br />site plan could have been configured in such as way to allow for the location of two <br />billboards in compliance with the provisions of Section 1008.08. <br /> <br />4. The only other property owner in the corridor where billboards have been allowed is the <br />Bridges Golf Course, which has already received approval for six billboards on golf <br />course property. Installation of billboards is not allowed on any other properties in the <br />City. <br /> <br />S. The variance requested is the minimum necessary to allow for the second billboard while <br />still maintaining a separation allowable by Minnesota Department of Transportation <br />permitting standards, which allows for a minimum spacing of 500 feet. <br /> <br />6. Granting a variance for a reduced minimum spacing between two billboards would not be <br />materially detrimental to the purpose of this Title or to other property in the same zone. <br /> <br />7. The proposed reduced spacing between the two billboards would not impair a supply of <br />light or increase congestion, nor would it increase the danger of fire or endanger the public <br />safety or diminish property values. <br />
