<br />. <br /> <br />. <br /> <br />. <br /> <br />Resolution 661-01 <br />July 18, 200 1 <br />Page 2 <br /> <br />WHEREAS, a public hearing was held Wednesday, June 20, 2001, with regard to this <br />variance request; and, <br /> <br />WHEREAS, according to Section 1125.02, Subdivision 2 of the Mounds View <br />Municipal Code, thc Planning Commission is to review a standard set of criteria, of which all <br />must be satisfied, in order to grant a Variance to the Zoning Code. <br /> <br />NOW, THEREFORE, BE IT RESOLVED, the Mounds View Planning Commission <br />hereby makes the following findings of fact related to this request: <br /> <br />1. 8081 Red Oak Drive is a corner lot and is zoned R-l Single-Family Residential. <br /> <br />2. Red Oak Drive, at the intersection with Sherwood Road, carries a substantial volume of <br />traffic, which at times causes significant delay in exiting or entering the property. <br /> <br />3. The existing driveway accesses Red Oak Drive, yet is locatcd only 20 feet from the <br />intersection of Red Oak Drive and Sherwood Road <br /> <br />4. Granting the variance for two curb cuts at the property would not confer upon the applicant a <br />spccial privilege because of the unique circumstances associated with the property. <br /> <br />5. The literal interpretation ofthe code would deprive the applicant a right to safe ingress and <br />egress to and from the property. <br /> <br />6. Granting a variance for a second curb cut would not be detrimental to the purpose of this <br />Title since the variance provision is intended to provide relief to property owners in unique <br />situations or when a hardship exists. <br /> <br />NOW, THEREFORE, BE IT FURTHER RESOLVED, the Mounds Vicw Planning <br />Commission, based upon its review of the documentation, testimony presented at the public <br />hearing, and the identified findings of fact, does hereby approve the variance request for a second <br />curb cut at 8081 Red Oak Drive to access Shcrwood Road, subject to the following conditions: <br /> <br />1. The applicant shall apply for and obtain a permit for the work already performed and <br />for any subsequcnt work related to the improvement of the new driveway. <br /> <br />2. The new driveway shall be improved with a pernlanent surface material such as <br />asphalt or concrete within three months of the variance approval. A one-time, three- <br />month extension to this requirement shall be permitted if requested in writing and for <br />good cause. Failure to comply with this provision within the prescribed time frame <br />will result in the variance being considered null and void. <br /> <br />3. The applicant shall arrange to have recorded with Ramsey County this resolution of <br />approval and provide proof of such recordation to the City within 60 days of the date <br />of approval, or this variance shall be rendered null and void. <br />
