Mounds View City Council June 12, 198.9 <br />' Regular Meeting Page Twenty-One <br />• The Council agreed to meet on June 29, beginning at 28. Report of <br />6:30 PM to review the management audit. Clerk/ <br />Administrator <br />Clerk/Administrator Pauley explained a problem has <br />been discovered with the Kraus Anderson property <br />where Super America and Silver View Plaza are <br />located, in that while it was believed to be a PUD, <br />no record can be found that it was rezoned that way. <br />The zoning map shows it to be B-2, and a building <br />permit was issued for the construction of a curb <br />cut between the two facilities. A stop order has <br />been placed on the building permit while the issue <br />is looked into. All other PUD property in the City <br />is shown as PUD on the zoning map. <br />Attorney Karney has advised the curb cut cannot be <br />stopped, and the City should not try to rezone to a <br />PUD now, but rather go with what was provided for <br />in the resolution. and if that is inconsistent with <br />what is actually there, go with that. The project <br />was approved in 1982, and a preliminary search through <br />the files cannot find the actual rezoning. <br />Mayor Hankner stated she had been contacted earlier <br />• by Kraus Anderson concerning this matter. She <br />explained the situation as she understood it from <br />discussions with the deverloper. <br />Clerk/Administrator Pauley recommended they allow the <br />building permit for the curb cut, and the Council <br />direct Staff to prepare an ordinance to accomplish <br />the rezoning as quickly as possible. <br />Motion/Second: Paone/Hankner to allow the building <br />permit for the curb cut between Super America and <br />Silver View Plaza, and direct Staff to prepare a <br />resolution to accomplish the rezoning of the property <br />as quickly as possible. <br />4 ayes 0 nays Motion Carried <br />There being no further business before the Council, 29.
