Mounds View City Council June 26, 1989 <br />Regular Meeting Page Seven <br />-------------------------------------------------------------------------- <br />Attorney Karney advised the taxes had not been paid <br />in full, nor other requirements met. for the renewal <br />of the liquor license on this property, but he has <br />researched bankruptcy laws and find that they take <br />precedence over other laws, in that the bankruptcy <br />filing applies only to debts at that time, and the <br />owner is still required to pay future taxes, <br />insurance, and so forth, and the owner must make <br />payment on all debts, including back taxes. The <br />bankruptcy payments should be kept in full force <br />and effect, and if they lapse, the license should <br />be revoked. <br />Clerk/Administrator Pauley advised the health <br />inspector from the County has revoked their autho- <br />rization, based on the lack of meeting health <br />standards, and the owner has been notified by <br />certified letter of that. They cannot serve <br />alcohol on Sundays now, as Sunday sales must be <br />in conjunction with food service. <br />Staff recommends the Council deny the renewal of <br />the Sunday sales liquor license and restaurant <br />license and allow the applicant to reapply once he <br />has received certification from the County health <br />department, and. also approve the on-sale liquor <br />license contingent upon payment of the outstanding <br />utility bill by 4:30 PM on Friday, June 30, 1989. <br />Motion/Second: Blanchard/Paone to approve the <br />on-sale intoxicating liquor license for Loose Ends <br />on 10 contingent upon the following: 1) payment <br />in full of all utilities and taxes charged after <br />the filing of bankruptcy; 2) compliance with the <br />legally approved bankruptcy payment plan; and 3) <br />payment of all past due utilities no later than <br />4:30 PM on June 30, 1989. <br />5 ayes 0 nays <br />Motion/Second: Quick/Wuori to deny the renewal <br />of the Sunday sales and restaurant license for <br />Loose Ends on 10. <br />5 ayes 0 nays <br />• <br />Clerk/Administrator Pauley reported all bills have <br />been paid, including past due taxes and utilities, <br />but they are still waiting for the insurance binder. <br />14.
