<br />Resolution No. 810-05 <br />PaUl' 2 of 2 <br />h <br /> <br />. <br /> <br />WHEREAS, according to Section 1125.02, Subdivision 2 of the Mounds Vie\v Municipal Code, the <br />Planning Commission is to re\'iew a standard sct of criteria. of which allll1ust be satisfied, in order to grant a <br />variance to the Zoning Code. <br /> <br />:\'OW, THEREFORE, BE IT RESOLVED, the Mounds View Planning Commission makes the <br />following finding of Illcts related to this request: <br /> <br />1. The property is zoned B-3. Highway Business District. <br /> <br />') <br /> <br />The thmt and side dri\'t~\vay setback in the B-3 District is five (5) feet. <br /> <br />3. The applicant is requesting a reduction of thc front and side driveway setback to improve \'Chicle <br />mo\'ements on the site and to satis1y tire code access requirements. <br /> <br />4. The subject property cannot provide lire code-compliant access to the rear of thc property but for a <br />reduction of the tl:ont and rear drive\vay setback. <br /> <br />5. Granting a variance to promote emergency \-chicle access would not confer a special privilege not <br />l'njoyed by other property owners. <br /> <br /> 6. <br /> 7. <br />. 8. <br /> 9. <br /> <br />The applicant did not cause or create the conditions which \varrant variance approval. <br /> <br />The variance would not be materially detrimental to the purpose of this Title in that there does not <br />appear to be any adverse effects resulting th)l11 approval of the variance. <br /> <br />A laur (4) foot reduction of the driveway setback is the minimumnl'eessary to alleviate the hardship. <br /> <br />The proposed variance would not impair supply of light and air to adjacent properties or substantially <br />increase the eongcstion of the public streets or increase the danger of fire or endanger the pub I ic safety <br />or substantially diminish or impair property valucs \vithin the neighborhood. <br /> <br />~OW, THEREFORE, BE IT FINALLY RESOLVED, the Mounds View Planning Commission. <br />based upon its review of the documentation. testimony presented at the public hcaring, and the identitied <br />Endings of fact. does hereby ;1pprove a four-foot reduction to the driveway setback on the northeast and cast <br />side of the property at 2832 County Road 10, as illustrated on the attached site plan, labeled Exhibit A. <br /> <br />Adopted this 7th day ofSeptcmber 2005. <br /> <br />~,#-._'_....._-_.,_.__.- . <br />,/ ~------ <br />,/..<-.
