Resolution 1050-16 <br />Page 2 of 3 <br />this request on May 18, 2016, and continued the Hearing on June 1, 2016; and, <br />WHEREAS, according to Section 1125.02, Subd 2, of the Mounds View <br />Municipal Code, the Planning Commission is to review a standard set of criteria, of <br />which all must be satisfied, in order to grant a variance to the City Code. <br />NOW, THEREFORE, BE IT RESOLVED, that the Mounds View Planning <br />Commission finds that the criteria as identified in Section 1125.02, Subd 2 of the <br />Mounds View Municipal Code are satisfied and finds there to be sufficient practical <br />difficulty with regard to the property located at 2848 Co Rd H2, and makes the following <br />findings of fact related to its decision: <br />The Variance is in harmony with the general purposes and intent of this Title. <br />2. The Variance is consistent with the Comprehensive Plan (Transportation Goals & <br />Policies); <br />Goal 1. Identify the improvements necessary to ensure the continued safety <br />and convenience of the transportation system for movement by all <br />modes. <br />Policy g. Establish and enforce standards and controls for business and <br />advertising signage and lighting to prevent driver distraction and <br />potential hazards. <br />The sign is proposed to be located at an intersection with a four-way stop sign. <br />The Planning Commission finds that the color of lights used in a Dynamic Display <br />Sign at this location shauld not distract drivers, nor create a potential hazard. <br />The City Code sufficiently prohibits the use of distracting signs, thus color alone, <br />is not a factor. <br />3. The applicant proposes to use the property in a reasonable manner, not <br />permitted by Section 1008.10, Subd 9(c)(2)(b) of the City Code. The Planning <br />Commission finds that the use of non-amber colors on the Dynamic Display sign <br />is a reasonable use. <br />4. The Planning Commission finds that unique circumstances exist on the property, <br />necessitating the use of non-amber colored lights on the Dynamic Display Sign. <br />5. The Variance does not alter the essential character of the neighborhood. The <br />Planning Commission finds that use of non-amber colors on the Dynamic Display <br />Sign will not alter the essential character of the neighborhood. <br />6. The Variance requested is the minimum Variance which would alleviate the <br />practical difficulties. The Planning Commission finds that the use of all colors on <br />the Dynamic Display Sign would alleviate practical difficulties. <br />
