Resolution 1075-17 <br />Page 3 <br />Brian Erickson, City of Mounds View Public Works, June 20, 2017 <br />Samantha Berger, Rice Creek Watershed District, June 23, 2017 <br />WHEREAS, the Planning Commission reviewed the request on July 19, 2017, including <br />the following documents: <br />Staff Report, dated July 19, 2017 <br />Preliminary Plat and related drawings, dated June 13; 2017 <br />Traffic Impact Study, dated June 8, 2017 <br />Housing Study; dated April 28, 2017 <br />WHEREAS, the City of Mounds View Municipal Code, Section 1204.02, Subd 4 <br />(Dedication Amount); allows for the dedication by the subdivider to the City, up to ten percent <br />(10%) of the buildable land; or cash equivalent (2017 estimated market value of land). This <br />dedication equals up to 0.35 acres, or up to $39,720 (2017 EMV); and, <br />NOW, THEREFORE, BE IT RESOLVED, the Planning Commission finds that the <br />request is consistent with the City of Mounds View Municipal Code, Section 1000 (Building and <br />Development Regulations), Section 1100 (Zoning Code), and Section 1200 (Land Subdivision), <br />and the Comprehensive Plan; and, <br />NOW, THEREFORE, BE IT FINALLY RESOLVED, based upon the above findings, <br />the information and documents regarding the proposed Preliminary Plat; the Staff Report, and <br />testimony of the applicant, and inconsideration of public testimony, the Planning Commission <br />does hereby recommend approval of the Preliminary Plat of `Boulevard", with the following <br />conditions: <br />The applicant, MWF Properties, LLC, shall comply with requirements and BMP's, as <br />stipulated by the Public Works Department (June 20, 2017 letter), and Rice Creek <br />Watershed District (June 23, 2017 email), including obtaining applicable ROW permits <br />from the City and County, and RC WD permits. <br />2. The applicant shall execute a Developers Agreement with the City, to be completed as <br />part of the Final Plat approval. The Developers Agreement will be inclusive of developer <br />installed improvements, including a publicly owned pedestrian trail, privately owned <br />fenced playground, landscaping and site improvements. <br />3. The applicant shall pay a Park Dedication Fee equal to 10% of the Estimated Market <br />Value (EMV) of land, current as of the date of approval of the Final Plat (2017 EMV = <br />$39,720) to the City of Mounds View prior to the City signing the Final Plat mylars. <br />4. The applicant shall satisfy all requirements made by the City Attorney as stated in the <br />plat opinion. <br />
