R .�� �. ! i ;:. <br />WFiEREAS, the appficanfi, Hamilton Creek, has applied for a variance from the <br />minimum front setback far a single-family dweiling und�r construction at 7741 Long <br />Lake Road; and, <br />�ilFi�R�AS, Section 11 O4:Q2 of the Mounds View Zoning Code indicates that ihe <br />minimum front setback far a principai building is 30 feet unfess the prevailing sefiback <br />far existing strucfures exceeds 3Q feet, in which case ihe prevailing set back IS the <br />minimum sefback; and, <br />►�lHE�EA�, the structure under construction, sef back 30.3 feei from t�e fronf <br />properfy line, is lacated within the "prevailing" set back on fhis block, which is 41 feef; <br />and, <br />�HEREAS, the applicant was issued a building permit for �he strucfure on <br />January 27, 2003 based on a survey indica�ing a 30.3-foot front set back; and, <br />WH��EAS, upon discovery of i�s error, the City issued a"Stop Wark" order on <br />fihe construcfion prompting the applicant to request a variance; and, <br />�HEREAS, according to Section 1125.02, Subdivision 2 af the fl�ounds View <br />Municipa[ Code, the Planning Commission is to review a standard set of criieria, of <br />which all must be satisfied, in order to grant a variance to fihe Zoning Code. <br />f�pV�, °fHEREFORE, �E IT RESOL.VED9 the Mounds View Pfanning <br />Commission makes the following finding of facts related to this request: <br />1. The exceptional or extraordinary condifions relating to #he variance requesf is <br />simply the Cify erred in i�s issuance af a building permit and did not discover <br />the error until work had substanfialiy began on the structure. <br />2. The (i#eral ir�terpretation of fhe Zoning Cod�, in conjunction with ihe City's <br />error, does deny the applic�nfi rights commonly enjoyed by other recipients df <br />building permits. <br />3. The applican� has not caused the condifiion which prompfiec� the variance <br />request. <br />4. �rar�ting fhe variance would n�t c�nfer upon the applicani a special privilege. <br />, <br />
