'. ! . � : : � • 'i .; <br />� - i �.. � �: �� "�,,' `-� � � <br />_- . � ; �. 1 ' ' ' �: . : �, .. - i "... � [. �� �. � � .,,. <br />WH�R�A�q #he Mounds View City Council approved the Theater PCanned Unit <br />Development {PUD) Agreemenf an May 11, 'l998; and, <br />W�tEREAS, the appraved uses for the iheater PUD included a theater, three office <br />buildings, restatarants and refail uses; ancf, <br />�FiER�A�, the lofi located at 2442 County Highway 10, Iegally described as Lot 1, <br />BEock 2; Anfhany Pi�operties Addition, was approved by the Council for a Restaurant use; <br />and, <br />WWEREAS, having been unabfe to develop the properfy with a resfaurant, the ' <br />, <br />developer wishes to amend the PUD Agre�rnent by adding "office" as an allowed use for <br />the site; and, <br />WHERE,4S, the Planning Commission has reviewed this request and has examined <br />the potential adverse effects that could resu(t from such an amendmenf. <br />NODU, TFiEREFORE, �E ii RE�OLV�D fihat the Mounds View Planning <br />Commission makes the following finding of fact reiated to this request: <br />1. The lot in question, 2442 County Highway 10, described by the cieveloper as <br />Outparcel "A," is zoned Planned Unit Development (PUD) and the only allowed use <br />for the site is a restaurant. <br />2. The (ot in question remains vacant and as such the developer has requested an <br />amendmeni to the PUD to allow for an office building to be cansfructed on ihe site. <br />3. The Future Land Use Map fram the City's Comprehensive Plan designates this area <br />as a Regional Commercial Planned Unit Develapmenf which is consistent with the <br />zoning of the site. <br />4. 2442 County Highway 10 is within the Cifiy's primary commercial corridor and as <br />such either a res�auranf or an office building would be a fitfiing deve�opment. <br />
