The irregular shape of the lot, ihe need to provide for <br />sto�mwater runoff storage, and the severe problems related fo redeveloping a former <br />gas station site are exceptional or extraordinary circumstances which do not generally <br />appiy to other properties. <br />Literal interpretation of the code would deprive the applicant of riqhts enioyed by other <br />properties. The site plan, as proposed, provides enough parking for the proposed <br />pharmacy and small additional retail. Typically a CVS/pharmacy store needs 70 parking <br />spaces to serve its customers and employees. The additional retail would require 15 <br />spaces. The development would not be possible without a variance. <br />The s�tback variance is needed in order to fit the proposed 95 spaces on fhe property. <br />Without a variance, it would not be possible to provide enough parking. Over one-third <br />of the parking spaces would be eliminated without the setback variance. <br />The special conditions or circumstances do not result from the actions of the Applicant. <br />The conditions are existing now and the Applicant is purchasing the property in its <br />existing condition. <br />The qrantinq of the variance will not confer anV special privilecte on the Applicant. There <br />are several other B-3 zoned properties in the City with similar setbacks and number of <br />parking spaces, <br />The variance requested is the minimum variance which would alleviate the hardship. <br />The building and parking area have been configured in order to request the least amount <br />of variance possible. The site plan has been prepared to strike a balance between the <br />need for a setback and parking space variances, and make the requests as minimal as <br />possible for both. <br />The variance would not be materiall detrimental to the purpose of the_ zoninc�code or to <br />other propertv in the same zoninq district. The _variance will further the purpose of the <br />zoninq code bV alleviatinq or preventincl conqestion. The variance will not have anv <br />adverse impact on surroundinq property owners. The proposed variances will further the <br />purpose of the zoning code by alleviating or preventing congestion. The variances will <br />not have any adverse impact on surrounding property owners, <br />The proposed variance will not impair an adequate supply of light and air to adjacent <br />propertv or substantially increase the conqestion of the public streets or increase the <br />danger of fire or endanqer thepublic safetv or substantiallv diminish or impair propertv <br />values within the neiqhborhood. Redevelopment of this parcel for use as a retail <br />pharmacy will have a positive impact on the neighborhood. The development will <br />provide adequate parking and access and will not endanger public safety. <br />
