Date of Report: March 7, 2001 Background: The Council is acutely aware of the background concerning this project. At the Council’s last regular meeting, Resolution 5527 was adopted which approved the development review request of Tony Mezzenga to construct a small office building on 7664 Greenfield Avenue. One of the conditions of this approval was that the applicant shall construct a four-foot wood fence along the south property line in addition to an eight-foot tall fence. Neither the applicant nor the adjacent land-owner to the south, Herb Zwirn, desires the addition of the four-foot fence. Discussion: Staff has drafted for the Councils review a resolution which would amend the original resolution by deleting the provision which required the four foot fence, replacing it with the originally proposed lilacs. All other provisions of the original resolution would remain in force. Both property owners are in agreement regarding to this request. Recommendation: Staff and the affected property owners request that the Council consider approval of the attached Resolution 5536. I will not be in attendance at the Council meeting, and I suspect that the property owners will not either.
