M:\MasterFiles\1999 thru 2010\2001\City Council\Council Packets\03-12-2001 Council\Item 07F--Staff Report & Res 5539, Innovative Immages--Kathleen Miller.doc <br />RESOLUTION 5539 <br /> <br />CITY OF MOUNDS VIEW <br />COUNTY OF RAMSEY <br />STATE OF MINNESOTA <br /> <br />RESOLUTION AUTHORIZING REPAYMENT OF THE OVERPAYMENT <br />TO INNOVATION IMAGES FOR THE YEAR 2000 <br /> <br />WHEREAS, the City of Mounds View entered into an Agreement with Innovative Images <br />on December 7, 1998 for the management of Mounds View Community Center Banquet <br />Center; and <br /> <br />WHEREAS, Innovative Images received $18,000 for the year ending 1999 per the <br />Agreement; and <br /> <br />WHEREAS, thereafter the Agreement stated under Article II, page two, “The City will make <br />monthly payments to Images based upon actual gross revenues; and <br /> <br />WHEREAS, Images was erroneously compensated for the year 2000 based upon <br />budgeted estimated revenues, which resulted in an overpayment of $8,092.71: and <br /> <br />WHEREAS, the City’s Attorney has advised recovery of this overpayment to Images per <br />Section IV of the Agreement; and <br /> <br />WHEREAS, Section IV provides that the City advise Images of the overpayment and allow <br />thirty days for correction of the situation; and <br /> <br />WHEREAS, the City Council reviewed this item at the March 5, 2001 Work Session, <br />directing staff to recover the overpayment of $8,092.71 to Innovative Images per the <br />Agreement. <br /> <br />NOW, THEREFORE, BE IT RESOLVED that the Mounds View City Council does hereby <br />authorize the repayment of the overpayment to Innovative Images. <br /> <br /> <br />ATTEST Adopted this 12th day of March, 2001 <br /> <br /> <br /> ___________________________________ <br /> Richard Sonterre, Mayor <br /> <br /> <br /> <br />SEAL ____________________________________ <br /> Kathleen Miller, City Administrator <br />
