Item No: 10 A Meeting Date: March 26, 2001 Type of Business: PH & CB WK: Work Session; PH: Public Hearing; CA: Consent Agenda; CB: Council Business City of Mounds View Staff Report To: Honorable Mayor & City Council From: James Ericson, Community Development Director Item Title/Subject: Discussion, Public Hearing and Consideration of Resolution 5540, a Resolution Approving a Development Review and Conditional Use Permit for Pinewood School, located at 5500 Quincy Street Date of Report: March 21, 2001 Discussion: The Planning Commission tabled action on this request for the second time at their meeting on March 21, 2001 because representatives from the school failed to attend the meeting or address Planning Commission and residents’ concerns regarding the project. Rather than canceling the public hearing scheduled for March 26, 2001and renotifying the residents, staff would suggest opening the public hearing and immediately continuing the public hearing to a future meeting. Staff will however consult with the City Attorney to ensure continuation of the public hearing without testimony or discussion is legal and appropriate. If the attorney advises against this, staff will inform the Council prior to the meeting. In response to concerns from the residents in attendance who received notices for the Council meeting, Staff assured the residents that the City Council would take NO ACTION on this request until the Planning Commission offered its recommendation to the Council. Recommendation: Open the public hearing then move to continue the public hearing to the next regular meeting date to allow the Planning Commission an opportunity to forward their recommendation to the City Council.
