MIPH Report to Council <br />March 26, 2001 <br />Page 6 <br /> <br /> <br />Recommendation: <br /> <br />Staff was not able to find any documentation in the minutes to support Mr. Winiecki’s <br />claim for a minimum building setback of 73 feet. However, even if staff had found such <br />assurances, the Council always retains the ability to approve or deny requested changes <br />to a PUD. The proposed MIPH plans are consistent with the approved PUD but deviates <br />from the original site plans reviewed and approved by the Council. For that reason, the <br />developer is seeking a reapproval from the City. Staff recognizes that the proposed <br />building setback of 50 feet will reduce the visibility of Mr. Winiecki’s building and fully <br />appreciates his concerns, but staff feels that even a 73-foot setback would greatly <br />diminish the visibility to the Winiecki building, which currently enjoys completely <br />unobstructed sight lines to Highway 10. The practical difference between a 50-foot and <br />73-foot setback to a motorist traveling 50 miles per hour is negligible. <br /> <br />Staff supports the site plans as proposed and recommends approval of Resolution 5541, <br />a Resolution approving a development review request for the Minnesota Institute for <br />Public Health, with stipulations. <br /> <br /> <br /> <br /> <br />_____________________________________ <br />James Ericson <br />Community Development Director <br />763-717-4021 <br /> <br /> <br />Attachments: <br /> <br />1.
