Item No: 7B <br />Meeting Date: 4/23/01 <br />Type of Business: CB <br />WK: Work Session; PH: Public Hearing; <br />CA: Consent Agenda; CB: Council Business <br />City of Mounds View Staff Report <br />To: Honorable Mayor & City Council <br /> <br />From: Jeremiah Anderson, Housing/Code Enforcement Inspector <br /> <br />Item Title/Subject: Discussion of resolution 5556, Ordering the abatement of <br />hazardous conditions existing at 2229 Kingsway Lane. <br /> <br /> <br />Date of Report: April 16, 2001 <br /> <br /> <br />Background: <br /> <br />Currently the manufactured home located at 2229 Kingsway Lane in Townsedge <br />Terrace Manufactured Home Park is in a hazardous condition due to inadequate <br />maintenance, dilapidation, and physical damage. An inspection of the home on <br />March 14, 2001 revealed numerous housing code violations as well as life safety <br />hazards. Additional inspections on March 22, 2001, April 3, 2001 and again on April <br />5, 2001 revealed numerous outstanding code violations. As such, the home is <br />unsafe for human occupancy and was posted to prevent its occupancy on April 5, <br />2001. <br /> <br /> <br />Discussion: <br /> <br />Minnesota Statute § 463.16 authorizes the governing body of any City or Town to <br />order the owner of any hazardous building or property within the municipality to <br />correct or remove the hazardous condition of the building or property, or raze or <br />remove the building. Additionally, Minnesota Statute § 463.161 authorizes the <br />governing body of any City or Town to correct or remove the hazardous condition of <br />any hazardous building or property. <br /> <br />Minnesota Statute § 463.15 Subd. 3 defines a hazardous building or hazardous <br />property as any building or property which because of inadequate maintenance, <br />dilapidation, physical damage, unsanitary condition, or abandonment, constitutes a <br />fire hazard or hazard to public safety or health. The manufactured home located at <br />2229 Kingsway lane meets these definitions and as such, is considered a hazardous <br />building. <br /> <br />Section 1005.16 Subd. 4 of the City Housing Code provides the City the authority to <br />abate, remove or otherwise remedy the violation and take any action permissible <br />under State law to specially assess or otherwise charge the cost of such abatement, <br />removal, or remedy against the premises where the violation was located.
