Clear Channel Resolution 5634 <br />October 22, 2001 <br />Page 12 <br />WHEREAS, the proposed development satisfies the requirements of the Zoning <br />Code and building code; and, <br /> <br />WHEREAS, the proposal satisfies all of the wetland requirements of Chapter <br />1010; and, <br /> <br />WHEREAS, on September 19, 2001, the Mounds View Planning Commission <br />approved Resolution 673-01 which recommended approval of the expanded billboard <br />and aesthetic improvements, subject to conditions; and, <br /> <br />WHEREAS, on October 22, 2001, the Mounds View City Council approved <br />Resolution 5627, a resolution approving a development review to expand the existing <br />billboard, with stipulations. <br /> <br />NOW, THEREFORE, BE IT RESOLVED that the Mounds View City Council <br />approves the Wetland Alteration Permit requested by Chris McCarver of Clear Channel <br />Outdoor to expand the billboard located at 2373 County Highway 10 and to make <br />associated landscaping improvements, contingent upon the following: <br /> <br />g. The applicant shall apply for and receive approval of a Rice Creek <br />Watershed District stormwater permit, and provide proof of such permit to <br />the City. <br />h. Only clean fill, if any is needed, shall be brought onto the site. <br />i. No waste, construction or otherwise, shall be allowed to enter into the <br />wetland or any adjoining areas. <br />j. The construction of the billboard base shall not impede or otherwise restrict <br />the natural flow of surface water and stormwater runoff. <br />k. Any reduction to the available flood storage capacity (area below the 902 <br />elevation) shall be restored or replaced immediately adjacent to the billboard <br />so that there is no net loss of available flood storage capacity to the site. <br />l.
