Ord. 679 Report <br />May 7, 2001 <br />Page 32 <br /> <br /> <br /> <br />1008.14 1008.09: ABROGATION AND GREATER RESTRICTION: Where the conditions imposed by any provisions <br />of this Chapter are either more or less than comparable conditions imposed by any other code, rule or regulation of the City, <br />the code, rule or regulation which imposes the more restrictive condition, standard or requirement shall prevail. (1988 Code <br />§39.14) <br /> <br /> <br />1008.15 1008.10: VIOLATION OF PROVISIONS: Any person found violating any of the provisions of this Chapter <br />shall be guilty of a misdemeanor. (1988 Code §39.15) <br /> <br /> <br /> <br />1008.16 1008.11: SIGN VARIANCES: <br /> <br />Subd. 1. A variance to the provisions of Section 1008 may be considered by the Board of Adjustment and Appeals to <br />provide relief to the landowner in those cases where the Code imposes undue hardship or practical difficulties to the <br />property owner. Applications shall be submitted and reviewed in the same manner as indicated in Chapter 1125 of <br />the Mounds View Zoning Code. (Ord. 644, 12-13-99) <br /> <br /> a. Exceptional or extraordinary circumstances apply to the property which do not apply <br />generally to other properties in the same zone or vicinity and result from lot size or shape, <br />topography or other circumstances over which the owners of the property since the effective <br />date hereof had no control. <br /> <br /> b. The literal interpretation of the provisions of this Title would deprive the applicant of rights commonly enjoyed <br />by other properties in the same district under the terms of this Title. <br /> <br /> c. That the special conditions or circumstances do not result from the actions of the applicant. <br /> <br /> d. That granting the variance requested will not confer on the applicant any special privilege that is denied by this <br />Title to owners of other lands, structures or buildings in the same district. <br /> <br /> e. That the variance requested is the minimum variance which would alleviate the hardship. <br /> <br /> f. The variance would not be materially detrimental to the purpose of this Title or to other property in the same <br />zone. <br /> <br /> g. Circumstances under which the literal interpretation of the provisions of this Title create an undue hardship on <br />the applicant. Economic hardships may be a circumstance for issuance of a variance. (Ord. 585, 7-15-96) <br /> <br /> <br />Subd. 2. Variance Requests; Fees: All requests shall be made in writing on the form provided by the City and the request <br />shall include the fee specified in the City's Fee Charges. All information required when applying for a sign permit, <br />as outlined in Section 1008.03, shall be required before the request for a variance is considered.
