The applicant and the owner shall consider adding a clause to the lease <br />agreement which states that the Lessee will refuse objectionable advertising <br />content such as tobacco products, alcoholic beverages and gambling. <br /> <br />4. If the placement of the second billboard is within 100 feet of a wetland, the <br />applicant shall apply for and obtain a wetland buffer permit. <br /> <br />5. If the applicant is unable to obtain the requisite billboard permits from the <br />Minnesota Department of Transportation, the interim use permit should be <br />considered null and void. <br /> <br />6. The applicant shall be responsible for obtaining any and all other necessary <br />governmental permits and/or approvals. <br /> <br />7. The applicant shall record or arrange to have recorded a copy of the City Council <br />resolution of approval with Ramsey County, within 60 days of final action on this <br />request, or the interim use permit shall be considered null and void. <br /> <br /> <br />NOW, THEREFORE, BE IT FURTHER RESOLVED that this interim use <br />permit becomes effective upon the effective date of Ordinance Nos. 655, 656 and 657. <br /> <br />NOW, THEREFORE, BE IT FINALLY RESOLVED that this interim use permit <br />shall expire on July 1, 2015 or at such time that the lease expires or the billboards <br />become abandoned or remain unused for a period of more than six months, whichever <br />occurs first. <br /> <br /> <br />Adopted this 24th day of April, 2000. <br /> <br /> <br />_____________________________ <br />Dan Coughlin, Mayor <br /> <br />ATTEST <br />_____________________________ <br />Michael Ulrich <br />Interim City Clerk / Administrator <br /> <br />(SEAL) <br /> <br /> <br />
