RESOLUTION NO. 5488 <br /> <br />CITY OF MOUNDS VIEW <br />COUNTY OF RAMSEY <br />STATE OF MINNESOTA <br /> <br />RESOLUTION APPROVING A WETLAND ALTERATION PERMIT FOR CHARLES <br />FISCHER AND GARY AND JANET REINECKE, 7375 AND 7373 KNOLLWOOD <br />DRIVE; MOUNDS VIEW PLANNING CASE WA00-001 AND WA00-002 <br /> <br /> <br />WHEREAS, Charles Fischer And Gary And Janet Reinecke have requested approval of a <br />Wetland Alteration Permit to excavate within a wetland area on their respective properties for <br />which they are owner of record, properties legally known as: <br /> <br />Lot 109, Spring Lake Park Knolls, Ramsey County, Minnesota and <br />Lot 110, Spring Lake Park Knolls, Ramsey County, Minnesota <br /> <br />WHEREAS, said properties are within a designated wetland area as defined by the City’s <br />Wetland Zoning District maps; and, <br /> <br />WHEREAS, the property owners are requesting City approval to excavate within the <br />wetland area to restore an open-water area of the wetland; and, <br /> <br />WHEREAS, the City Council has found that wetlands within the City, as part of the <br />ecosystem, are critical to the present and future health, safety and general welfare of the land, <br />animals and people within the City, as well as within the Rice Creek Watershed District; and, <br /> <br />WHEREAS, the City Council has in mind its statutory obligation to comply with <br />Chapters 104, 105 and 112 of Minnesota State Law, the regulations of Rice Creek Watershed <br />District, Regulations of the Department of Natural Resources, including provisions for protected <br />waters, Public Law 92.500 (Federal Water Pollution Control Act), open space policies of the <br />Metropolitan Council and its guidelines encouraging protection and enhancement of marshes, <br />wetlands in the flood plain area and the public interest in preventing irreparable destruction or <br />deterioration of valuable natural resources; and, <br /> <br />WHEREAS, Section 1010.08 of the Municipal Code states that a Wetland Alteration Permit <br />is required when any activities encroach into a designated wetland; and, <br /> <br />WHEREAS, Rice Creek Watershed District (RCWD) on October 2, 2000, and October <br />31, 2000, approved the issuance of watershed permits for the requested activity; and, <br /> <br />WHEREAS, all grading and excavation activities are to be restricted to the subject <br />properties and shall not disturb any area beyond the subject properties; and, <br /> <br />WHEREAS, representatives from the City’s engineer have reviewed the request and <br />have determined that the proposed activity will not negatively impact the wetland or the <br />subwatershed. <br />
