Item No: 10A <br />Meeting Date: July 24, 2000 <br />Type of Business: Council Business <br /> <br />City of Mounds View Staff Report <br />To: Honorable Mayor & City Council <br />From: James Ericson, Planner <br />Item Title/Subject: Public Hearing and First Reading (Introduction) of <br />Ordinance 658 Regarding Fences and Fence Heights. <br />Date of Report: July 20, 2000 <br /> <br />Background: <br /> <br />This Ordinance 658 grew out of a desire to allow for some flexibility regarding the <br />height of fences in front yards. As the Council may recall, this was discussed relative <br />to two planning cases: the Messiah Lutheran Church expansion and the Brunes’ fence <br />variance request on Groveland Road. (With regard to the Messiah case, the Council <br />required that an 8-foot tall fence be located in the front yard of Messiah between its <br />proposed parking lot and the adjoining residential property to the east.) <br /> <br />The Planning Commission has recommended adoption of this ordinance. A copy of <br />Resolution 625-00, which they approved at their July 19th meeting, has been attached <br />for your reference. <br /> <br />Discussion: <br /> <br />The changes contemplated by Ordinance 658 are minimal, however the consequence <br />is such that the Council may require or allow a fence up to eight feet tall in a front <br />yard to satisfy buffer, screening or privacy issues. <br /> <br />Ordinance 658 adds the following language to Section 1103.08, Subdivision 3: <br /> <br />“The City Council may require or approve fencing up to ninety-six <br />inches (96") in height in a front yard to satisfy a buffer or screening <br />condition of a development review or conditional use permit.” <br /> <br />Recommendation: <br /> <br />Staff and the Planning Commission recommends that the City Council hold the first <br />reading of this ordinance and schedule the second reading and adoption of this <br />ordinance on August 14, 2000. <br /> <br /> <br />_____________________________________ <br />James Ericson, Planner <br /> <br />Attachments: <br />1.
