1st Read, Ord. 664 <br />July 24, 2000 <br />Page 4 <br />ORDINANCE NO. 664 <br /> <br />CITY OF MOUNDS VIEW <br />COUNTY OF RAMSEY <br />STATE OF MINNESOTA <br /> <br />AN ORDINANCE AMENDING CHAPTER 1106 OF THE MOUNDS VIEW ZONING CODE PERTAINING <br />TO PERMITTED AND CONDITIONALLY PERMITTED ACCESSORY STRUCTURES <br /> <br />THE CITY OF MOUNDS VIEW ORDAINS: <br /> <br /> SECTION 1: Section 1106.02 of the Mounds View Zoning Code is hereby amended with the proposed <br />additions underlined and the proposed deletions struck out, to read as follows: <br /> <br />1106.02: PERMITTED USES: The following are permitted uses in an R-1 District: <br /> <br />Subd. 1. Single-family detached dwellings. (Ord. 575, 7-15-96) <br /> <br />a. Each applicant for a building permit to construct any dwellings shall be required to provide off-street parking <br />spaces for at least two (2) automobiles per family in addition to any garage spaces to be used. <br /> <br />b. Every dwelling house hereafter erected shall be so located on the lot so that at least a two (2) car garage, either <br />attached or detached, can be located on said lot. <br /> <br />c. No permit shall be issued for the construction of a residential dwelling unless the driveway servicing the property <br />is to be improved with a permanent surfacing material so as to control dust, drainage and erosion, according to the <br />requirements as set forth in Section 902.05 of this Code, except that the property owner may provide a signed, <br />notarized statement in which the property owner agrees to improve the driveway in conjunction with the desired <br />construction activities or within six (6) months of the commencement of such activities, in a form acceptable to the <br />City Attorney. For the purposes of this Title, permanent surfacing materials are defined as concrete, asphalt or <br />brick. (Ord. 620, 7-27-98) <br /> <br />Subd. 2. Permitted single-family uses allowed under Minnesota Statutes, section 462.357, subdivision 7, as follows: <br /> <br /> a. A state licensed residential facility serving six (6) or fewer <br />persons, except as provided in subdivision 3 of this Section 1106.02; <br />(Ord. 596, 3-10-97) <br /> <br /> b. A licensed day care facility serving twelve (12) or fewer persons; <br /> <br /> c. A group family day care facility licensed under Minnesota Rules, parts 9502.0315 to 9501.0445 to serve fourteen <br />(14) or fewer children; <br /> <br /> d. Residential facilities whose primary purpose is to treat juveniles who have violated criminal statutes relating to <br />sex offenses or have been adjudicated delinquent on the basis of conduct in violation of criminal statutes relating to <br />sex offenses shall not be considered a permitted use. (Ord. 575, 7-15-96) <br /> <br />Subd. 3. Notwithstanding the provisions of subdivision 2.a. herein, foster family homes as defined in Minnesota Rules, <br />chapter 9545, section 9545.0010, subp. 7, which relate to the Department of Human Services and group homes and <br />group foster homes as defined in Department of Correction Rules, extracted from Minnesota Rules, chapter 2925, <br />section 2925.0100, subp. 9, shall be allowed as permitted uses to serve not more than eight (8) children per home, <br />not including the foster family's own children.
