death, resignation in writing filed with the City ManagerClerk- <br />Administrator, removal from office, non-residence in the City, conviction <br />of a felony of any such person after their election, or by reason of the <br />failure of any Councilmember without good cause to attend Council <br />meetings for a period of three consecutive months. In each such case the <br />Council shall by resolution declare the vacancy to exist. <br /> <br /> Section 2.09. Interferences with Administration. Neither the <br />Council nor the Mayor nor a Council member may dictate the <br />appointment by the City Manager of a person to an office or <br />employment. The Council may not interfere with the City Manager or <br />prevent the City Manager from exercising judgment in the <br />appointment of officers and employees in the administrative service. <br />Except for purposes of inquiry the Council and its members must deal <br />with and control the administrative service solely through the City <br />Manager. Neither the Mayor, the Council nor a Council member may <br />give orders, publicly or privately, to a subordinate of the City <br />Manager. <br /> <br />SECTION 3. <br /> <br /> The City Council of the City of Mounds View, pursuant to Minnesota Statutes <br />Section 410.12, Subdivision 5, proposes that Chapter 7, Section 7.04, Subdivision 1, <br />Section 7.06, Subdivision 1, and Section 7.07 of the Charter of the City of Mounds View <br />are hereby amended, and a new Section 7.13 and new a Section 7.14 are created, by the <br />addition of the bold and double-underlined language and by the deletion of the bold and <br />stricken language as follows: <br /> <br /> Section 7.04. Submission of Budget. <br /> <br /> Subdivision 1. Annually the City ManagerClerk-Administrator <br />shall submit to the Council the budget estimates in accordance with a <br />budget calendar to be established by resolution. The budget shall provide <br />a complete financial plan for all City funds and activities for the ensuing <br />fiscal year and except as required by state law or this Charter, shall be in <br />such form as the Council may require. It shall include a summary and <br />show in detail all estimated income and all proposed expenditures, <br />including debt service and comparative figures for the current fiscal year, <br />actual and estimated, and the preceding year. In addition to showing <br />proposed expenditures for current operations, it shall show proposed <br />capital expenditures to be made during the year and the proposed method <br />of financing each such capital expenditure. The total proposed operating <br />budget to be provided from the property tax shall not exceed the amounts <br />authorized by state law and this Charter. Consistent with these provisions, <br />the budget shall contain such information and be in the form prescribed by <br />ordinance and by state law.
