Item No: 10 C <br />Meeting Date: May 22, 2000 <br />Type of Business: PH & CB <br />WK: Work Session; PH: Public Hearing; <br />CA: Consent Agenda; CB: Council Business <br />City of Mounds View Staff Report <br />To: Honorable Mayor & City Council <br />From: James Ericson, Planner <br />Item Title/Subject: Public Hearing, Discussion and Consideration of a <br />Conditional Use Permit for an Oversized Garage at <br />2832 Woodale Drive <br />Date of Report: May 17, 2000 <br /> <br />Background: <br /> <br />The applicant, Thomas Stampfle, is requesting approval of a conditional use permit to construct <br />a 1,248 square-foot garage on his property located at 2832 Woodale Drive. The heavily wooded <br />37,000 square-foot lot is well maintained and improved with an older, one and a half story cape <br />cod and a small two-car garage attached to the home by a breezeway. The existing garage will <br />be demolished to make room for the proposed garage, which would be built in the same location <br />attached to the breezeway in the side yard. There is a small 10 x 10 shed on the property, <br />hidden in the woods. <br /> <br />Discussion: <br /> <br />Section 1106.4, Subdivision 6, lists the specific conditional use permit requirements for garages <br />larger than 952 square feet. These requirements, such as setbacks and maximum square-footage <br />would be met with this proposal. The setbacks for an accessory structure are five feet; the <br />applicant is proposing to reconstruct the garage 10 feet from the side property line and 70 feet <br />from the street. The Code sets an upper limit of accessory storage space on a property at 1,400 <br />square feet. With the proposed garage and the shed in the woods, there would be 1,348 square <br />feet of accessory buildings on this lot, fifty-two square feet less than the maximum allowed. <br /> <br />According to Section 1125.01, Subd. 3, of the Zoning Code, the City Council is to consider eight <br />general conditional use permit requirements in addition to the advice and recommendation of the <br />Planning Commission. These general criteria with responses are as follows: <br /> <br />1. The use will not create an excessive burden on existing parks, schools, streets and other <br />public facilities and utilities which serve or are proposed to serve the area. <br /> <br /> It is not expected that the oversized garage would have any impact on existing parks, schools, <br />streets and other public facilities and utilities which serve this area. <br /> <br />2. The use will be sufficiently compatible or separated by distance or screening from adjacent <br />residentially zoned or used land so that existing homes will not be depreciated in value and <br />there will be no deterrence to development of vacant land. <br /> <br />In addition to a privacy fence alongside the existing garage, this lot is heavily wooded which <br />acts as a natural buffer and screen between the proposed garage and neighboring properties. <br /> It is not expected that the proposed garage would detrimentally impact either the subject
